1. Introduction and Acceptance
Welcome to BoatPartsManual.com (the "Site", "we", "us", or "our"). By accessing or using our Site — whether as a visitor or a registered user — you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site.
Your use of the Site is also governed by our Privacy Policy, Cookie Policy, and Affiliate Disclosure (collectively, "Related Policies"), which are incorporated into these Terms by reference. Please read them. In case of conflict between these Terms and a Related Policy, these Terms govern unless a Related Policy expressly states otherwise.
2. Our Service
BoatPartsManual.com is a marine parts catalog and compatibility platform. We help boat owners search and browse parts that are indicated as compatible with their specific boat (brand, model, and year) and provide links to third-party retailers where those parts can be purchased.
We are not a seller. We do not sell products, hold inventory, set prices, handle payments, or fulfill orders. We are not a party to any transaction you make with a third-party retailer. All purchase terms — including price, availability, shipping, returns, and warranties — are strictly between you and the retailer.
3. Affiliate Disclosure
The Site participates in affiliate programs with third-party retailers (such as Defender, SVB, and others). When you click a link to a retailer's site and make a qualifying purchase, we may earn a commission or other compensation. This does not affect the price you pay.
- No endorsement. Linking to a retailer or product does not constitute our endorsement of that retailer or product. You should make your own purchasing decisions.
- Retailer's terms apply. All purchase terms (price, availability, shipping, returns, warranties) are governed by the retailer's terms and conditions, not ours.
- No abuse. You may not manipulate affiliate tracking mechanisms (e.g. cookie stuffing, artificial click generation) or use our affiliate links for any purpose other than genuine personal purchases.
For full details of our affiliate relationships, see our Affiliate Disclosure page.
4. Compatibility Information and Disclaimers
4.1 Compatibility / Fitment
All compatibility and fitment information on the Site is provided for informational purposes only. We do not guarantee that any part will fit your specific boat. You are solely responsible for verifying fitment with the manufacturer, a qualified installer, or another authoritative source before purchasing. We are not liable for wrong-part purchases, installation issues, or any damage resulting from reliance on compatibility information shown on the Site.
4.2 Prices and Availability
Any prices or availability information displayed on the Site is indicative and may be out of date. The retailer's website is the authoritative source for current price, stock, and delivery terms. We are not liable for any discrepancy between prices or availability shown on the Site and those on the retailer's site.
4.3 No Warranty
The Site and all content are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
Mandatory warranties: Nothing in these Terms excludes or limits any warranty or right that cannot lawfully be excluded or limited under applicable law (for example, statutory consumer rights in your jurisdiction).
4.4 Third-Party Content and Links
We are not responsible for the content, pricing, availability, terms, or practices of any third-party retailer, manufacturer, or website linked from the Site. Links are provided for convenience only. We do not control third-party sites and are not liable for any loss or damage arising from your use of them.
4.5 User-Generated Content
Users are responsible for the accuracy and legality of any content they submit (reviews, compatibility notes, feedback). We do not warrant the accuracy of user-generated content and may remove it at our discretion.
5. Limitation of Liability
To the maximum extent permitted by applicable law, BoatPartsManual.com and its operators, employees, agents, and licensors will not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages;
- Loss of profits, revenues, data, goodwill, or other intangible losses;
- Damages resulting from your reliance on compatibility information, affiliate links, or third-party content;
- Damages arising from your inability to access or use the Site.
Liability cap: Where our liability is not otherwise excluded, our total liability to you for any claim arising under these Terms is limited to the greater of: (a) the amount you paid to us in the twelve months preceding the claim, or (b) €50 / 500 SEK (or equivalent in your local currency). If you have not paid us anything, our aggregate liability is zero, except where prohibited by mandatory law.
Mandatory exceptions: This limitation does not apply to: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by applicable law.
EU / consumer rights: If you are a consumer in the European Union or another jurisdiction with mandatory consumer protection laws, your statutory rights are not affected by these limitations. Nothing in these Terms reduces or overrides rights you have under mandatory consumer protection legislation.
6. User Accounts
6.1 Registration
If you create an account, you must provide accurate, current, and complete information and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
6.2 Suspension and Termination
We reserve the right to suspend or terminate your account, with or without prior notice, for breach of these Terms, suspected fraud, or any other conduct we determine to be harmful or illegal. Where required by applicable law, we will provide reasonable notice before termination.
6.3 Effect of Termination
Upon termination, your right to access the Site under your account ends. Provisions of these Terms that by their nature should survive termination — including Sections 4 (Disclaimers), 5 (Limitation of Liability), 7 (User-Generated Content), 9 (Intellectual Property), 12 (Governing Law), and this clause — shall survive.
7. User-Generated Content
7.1 Your Responsibility
You are solely responsible for any reviews, compatibility notes, feedback, or other content ("UGC") you submit to the Site. You represent and warrant that your UGC: (a) does not infringe any third party's intellectual property rights; (b) is not false, defamatory, misleading, or illegal; and (c) complies with these Terms.
7.2 License You Grant Us
By submitting UGC, you grant BoatPartsManual.com a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, display, adapt, translate, and create derivative works from your UGC, solely for the purposes of operating, improving, and promoting the Site. We may sublicense or transfer this license only to the extent necessary for those purposes (for example, to service providers who operate the Site or in the event of a transfer of the Site). This license ends when you delete your UGC (or your account), except to the extent your UGC has been shared with others and they have not deleted it.
7.3 Moderation
We reserve the right — but not the obligation — to moderate, edit, or remove any UGC that we determine, at our sole discretion, violates these Terms, applicable law, or our community standards.
8. Acceptable Use
You agree not to use the Site to:
- Violate any applicable laws or regulations.
- Post false, defamatory, harassing, infringing, or spam content, or impersonate any person or entity.
- Scrape, crawl, or otherwise automatically extract data from the Site without our explicit written permission.
- Circumvent or attempt to circumvent security measures or access controls, or attempt to access areas of the Site not intended for public access (e.g. admin areas).
- Abuse affiliate tracking mechanisms (e.g. cookie stuffing, artificial clicks, or any manipulation of affiliate attribution).
- Overload, disrupt, or impair the Site's servers, infrastructure, or other users' access.
- Upload or transmit malware, viruses, or any other harmful code.
We reserve the right to investigate and take appropriate legal action against violations, including termination of accounts and reporting to law enforcement.
9. Intellectual Property
9.1 Our Content
All design, code, text, graphics, logos, and original content on the Site are owned by BoatPartsManual.com or our licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or sublicense our intellectual property without our prior written permission, except as expressly permitted by these Terms or applicable law.
9.2 Third-Party Trademarks
Product names, manufacturer names, trademarks, and logos displayed on the Site belong to their respective owners. Their display does not imply any affiliation with or endorsement by BoatPartsManual.com.
10. Privacy and Data
Your use of the Site is subject to our Privacy Policy, which describes how we collect, use, store, and protect your personal data, and your rights in relation to that data. By using the Site, you acknowledge that you have read and understood the Privacy Policy.
Our use of cookies and similar tracking technologies is governed by our Cookie Policy. Where required by law, we will obtain your consent before placing non-essential cookies.
We do not sell your personal data to third parties for marketing purposes. Affiliate partners may receive attribution data (e.g. a click originated from our site) as part of standard affiliate tracking; their use of that data is governed by their own privacy policies.
11. Changes to These Terms
We may update these Terms from time to time to reflect changes in our service, applicable law, or other circumstances. When we do, we will:
- Post the updated Terms on the Site and update the "Last updated" date;
- For material changes, provide reasonable advance notice (e.g. by email or prominent notice on the Site) and, where required by applicable law, obtain renewed consent.
Your continued use of the Site after the effective date of updated Terms constitutes your acceptance, subject to any mandatory consent requirements under applicable law. If you do not agree to the updated Terms, you should stop using the Site and, if applicable, delete your account.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of Sweden, without regard to its conflict of law principles.
Informal resolution first. We encourage you to contact us first (via the contact or feedback option on the Site) to seek an informal resolution of any dispute. If the dispute cannot be resolved informally within a reasonable time, it shall be subject to the jurisdiction of the courts of Sweden.
EU consumers: If you are a consumer habitually resident in the European Union, you retain the right to bring proceedings in the courts of your country of residence, and the above choice of forum does not deprive you of that right. EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
Consumers in Sweden may also refer disputes to the National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN) where applicable.
13. General
13.1 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.
13.2 Entire Agreement
These Terms, together with the Related Policies referenced herein, constitute the entire agreement between you and BoatPartsManual.com regarding your use of the Site and supersede any prior agreements on that subject.
13.3 No Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
14. Contact Us
If you have questions about these Terms, please contact us via the feedback or contact option on the Site.
